Sioux County Attorney Coleman McAllister says that 36-year-old Shawn Michael Sunday of Orange City was sentenced for the crimes of Attempted Burglary in the Third Degree, an aggravated misdemeanor; Possession of Marijuana, a Serious Misdemeanor; and Possession of Prescription Drug or Device Without Prescription, a Serious Misdemeanor.
On September 21, 2012, the Orange City Police Department received a report from an Orange City resident of a possible burglary. The Orange City Police responded and discovered that the resident reported that someone had attempted to gain access to his home by prying on the deadbolt. The resident identified Shawn Sunday as a possible suspect and informed the police that Sunday intended to steal prescription medications from the home. A short while later, a police officer was flagged down by a motorist in Orange City reporting an intoxicated person at the corner of Colorado Avenue SW and 6th Street SW. The officer went to the location and found Sunday in a state of intoxication due to drug usage. The officer searched Sunday and found him to be in possession of marijuana and a number of prescription drugs to which he could not produce a valid prescription.
After pleading guilty on January 14, 2013, Sunday was sentenced to serve 180 days in the Sioux County Jail on each count, with the sentences to run concurrently. He was also ordered to pay restitution to the victim and obtain a substance abuse evaluation and follow any recommended treatment.
